Kissimmee Underage DUI Attorneys

Under 21 and arrested for DUI in Florida?

Are you under 21 and were you arrested for DUI? Or, are you a parent whose son or daughter was recently arrested for an underage DUI? At Meléndez Law Offices, P.A., our Kissimmee DUI attorneys are dedicated to defending the constitutional rights of our community members, and we can provide you with the hard-hitting defense representation you're looking for!

What Are the Penalties?

While it's against the law for adults to drive with a blood alcohol level of .08% in Florida, for drivers under 21, the legal limit is .02% or higher under Florida's zero tolerance law. This means that if an underage driver is stopped by the police and found to have a BAL of .02% or higher, their license will be automatically suspended for 6 months.

This .02% limit was established so young drivers couldn't have a single drink and drive, and that was the whole idea. The driver's license suspension can be increased if the driver's BAL was over .05%, or if the driver had a BAC of .08%, they face the same penalties as an adult, which include:

First DUI Offense (BAL of .08% or above)

  • A fine of $500 to $2,000
  • Six months driver's license suspension
  • Mandatory 50 hours of community service
  • Probation – not to exceed 1 year
  • Up to 9 months in jail
  • Vehicle impoundment or immobilization for 10 days
  • DUI school
  • Increased insurance premiums
