What are the penalties for DUI?

In Florida, it's unlawful to drive when one's normal faculties are impaired, or to drive with a blood alcohol level (BAL) of .08% or above.

First DUI Conviction

  • Fines between $500 and $1,000. With a BAL of .15% or higher or minor in the vehicle: fines ranging between $1,000 and $2,000.
  • Driver's license revocation for 180 days to 1 year.
  • Mandatory 50 hours of community service, or an additional fine of $10 for each hour of community service.
  • DUI school
  • Probation – not more than 1 year
  • Up to 6 months in prison. For BAL of .15% or higher or a minor in the vehicle: not to exceed 9 months. Imprisonment is at the court's discretion. Sentencing may be served in a residential alcoholism or drug abuse program, which would be credited towards the term of imprisonment.
  • Vehicle impoundment or immobilization for 10 days, unless the defendant's family has no other transportation.

All DUI offenders must attend DUI school before hardship reinstatement. For people who wait out their revocation period before reinstating their license, they need to show proof of enrollment or completion to reinstate their license.

If the individual fails to complete DUI school within 90 days of reinstatement, their driver's license will be cancelled and the driver cannot be relicensed until DUI school is completed.
